GENERAL CONTRACT TERMS
At Adapt Landscapes we pride ourselves on high quality work, but crafting in the great outdoors gives way to nuance and subtleties and we want to establish reasonable expectations up front. The bottom line is that we want your project to be the best it can be and we will work as hard as we can to ensure that. Please read our general contract terms carefully and check with us if you have any concerns or questions.
Warranties: Adapt Landscapes provides a one year limited warranty on certain plantings provided that proper maintenance procedures are practiced, like fencing being kept up and watering schedule being followed. We cannot guarantee every plant in the planting, but if a species goes missing and the proper maintenance has taken place, we may replace that species after figuring out what happened and making sure it can’t happen again. The customer is solely responsible to ensure adequate watering and maintenance of all plant material after installation. We are happy to answer questions you have after planting, but on site visit will require a consultation fee of $150. The time period begins on the last day of work and upon signing of the Landscape Maintenance Agreement and sign off on the Completion Checklist. The foregoing warranties will be voided if the customer or a third party performs any work on the project site after the completion of Adapt Landscapes work or if client fails to maintain the project site in a reasonable manner.
Substitutions: We have good relationships with plant suppliers and make valiant efforts to ensure all the agreed upon plants are available. However, we have no control over production at greenhouses. Therefore, not all species in the design may be available at the time of planting. Specific plant selections, numbers, and sizes in the design are subject to substitution should stock become unavailable. In this case we will choose appropriate and aesthetically comparable plants in their place and document the changes
Yard Repair: As a rule we always clean up and leave places better than we find them. Should a project require machinery that could cause damage to other parts of your lawn/grounds we bill for repair on a Time and Materials basis – we can customize this to your needs, and you can waive it if you wish to do it yourself.
Watering Schedule and Fencing: Customer is responsible for maintaining a watering schedule for newly installed garden. Please follow our guidelines. We fence newly installed gardens because they are a buffet of tasty treats for cute but pesky rabbits and deer. Please know these fences can come down ONLY after the garden is established and that we will not be responsible for replacing plants that get eaten if fencing has come down early.
Site Documentation: Customer agrees to allow Adapt Landscapes access to the project site at times, before, during, and after the completion of the project for purposes of documentation and business promotion. Prior notification will be given. Business promotion can include: yard signs, social media posts, garden tours.
Delays: Although Adapt Landscapes will undertake to avoid all unnecessary delays with respect to landscape construction, the customer hereby acknowledges that Adapt is not responsible for circumstances beyond our control including adverse weather, availability or late delivery of materials, strikes, or failure of sub contractors retained by the customer to complete other necessary prerequisite work prior to project start.
Insurance: Adapt Landscapes carries insurance for general liability and property damage along with workers’ compensation coverage for employees.
Unforeseen costs: Apapt Landscapes is not responsible for any unforeseen costs that may occur during the landscape construction process. This includes excavation of hidden rocks, tree trunks, removal of landscape fabric, foundations, wells, septic tanks and fields or vandalism. These items will be considered extras to the contract and will be brought to the customers’ attention immediately. We will not perform any such additional services without consent of the customer. That consent will include any adjustment to the project price that results from the additional work.
Utilities: Adapt Landscapes is responsible for contacting all local public utility companies with respect to Telephone, Cable, Gas, Water, Etc. Any property line demarcation (through survey plan or otherwise) and private utilities including septic and well systems, shall be the sole responsibility of the customer to identify. Adapt is not responsible for any claims for damages caused to private utilities and work relating to property line locations.
Existing systems: Adapt Landscapes is not responsible for damage to existing automatic irrigation systems, lighting, or drainage systems. Please notify us if these exist and we will do our best to work around them.
Cancellations: Adapt shall be entitled to compensation for services performed and material purchased up to point of notification if the customer chooses to terminate contract or abandon project prior to completion. Cancellation of a contract prior to project start will result in a fee equal to 2% of the contract price for the project, for processing and refunding deposits.
Scheduling warranties: Warranty work will not be completed until all contract payments are paid in full.
Estimates: Our estimates reflect the end cost of a service if only the agreed upon work is completed. Changes in work to be completed will cause an increase in the final bill.
Deposits: A 25% non-refundable deposit of the estimated total is required before design, installation or maintenance work will commence.
